Motion to Extend Time to File Plan - Subchapter V

Under 11 U.S.C. §1189(b), the debtor must file a Subchapter V Plan within 90-days after the Order For Relief, unless the Court extends the deadline (for cause).
If the 90-day deadline expires before the objection period to the motion expires, an immediate telephone conference should be scheduled.
Filing Requirements:
- Motion to Extend Time to File Subchapter V Plan
- Notice of Motion
- 14-day object period; unless circumstances require a different notice period.
- Notice must be served on:
- All Creditors United States Trustee
- Subchapter V Trustee
- Proof of Service
- Proposed Order (May be filed after the objection period expires)
- Proposed Order must (a) Reference 11 U.S.C. §1189(b); (b) Clearly state the new deadline for filing the Subchapter V plan.
To File Plan Electronically:

Log into CM/ECF.

Select [Bankruptcy > Motions/Applications]

Enter the case number (e.g, xx-xxxxx).

Select "Extend Time to File Sub V Plan" event

Select the party filer. If the party is not listed, click on Add/Create New Party.
Note: The Attorney/Party Association screen may appear. If your party selection was correct, check the box to create an association.

Browse to select the Amended Motion (.pdf file).

Note: The Motion, Notice of Motion and Proof of Service may be:

A single PDF, or
-
The Motion is the main documents with the Notice and Proof of Service attached.

The Motion must be the first document in the PDF.

Enter the last day to to object (Default = 14 days; Modify if necessary)

Remove the objection date if no Notice of Motion is filed.

Modify the docket text if appropriate

Verify the final docket text; if correct, click [Next] to submit your document(s).
Note: The Notice of Electronic Filing displays giving you the document number. Copies of this notice are immediately e-mailed to all participants who receive electronic notification in the case.

Docket the Proposed Order (if not previously filed)
